N2.5bn suit: We may settle with arms dealer - Shell

Multinational Company, Shell Petroleum Development Company (SPDPC) has stated that it may settle out of court with an arms dealer in a N2.5billion suit that has been going on for the past 16 years.

This was disclosed before Justice J.T Tsoho of the Federal High Court sitting in Igbosere, Lagos by its lawyer, Olu Daramola (SAN), in a N2.5billion suit filed against the oil company by an arms dealer, Chief Gabriel Akinluyi over breach of contract.

During resumed hearing in the matter last Friday, Daramola stated that subsequent to Justice Tsoho’s advice to parties in the suit to settle the matter, he had presented the case to his client’s representative who was in court. He told the court that the representative said the matter has been passed on to the management but with no reply.
“Even before the intervention of your Lordship, parties had had meetings but nothing concrete came out of it. The representative called to say that the management is yet to take a decision on the new initiative.

“We are therefore asking for an adjournment to see if it is possible for the matter to be settled amicably,” he said.
In his reply, counsel to the plaintiff, Bambo Adesanya (SAN) assured that his client is ready to settle with Shell.
“There have been moves to settle the matter earlier in the year. It is clear that we have always been eager for an amicable settlement of the issue before the court.”

“We are not averse to the management taking a decision in this matter which we sincerely hope can be communicated to us before the next time we appear in court.”
Consequently, the court adjourned the matter till December 16, 2011 for continuation if the parties are unable to settle but it instructed them to inform the court if they reach an agreement.
